What next?

 

When you have entered into a contract, you may need some assistance with ‘what happens next’. Below are basic timelines stating the services of a settlement agent in relation to a sale and purchase of real estate:-

 

Purchase of a Property

 

  • Call Mastai Settlements and ask for advice, preferably before you enter into a contract for sale;
  • Ensure you know the correct purchaser as shown on the contract, as any changes after this stage can sometimes cause State Revenue to view the change as a second transfer, and therefore charge additional stamp duty. *Note, if you are buying on behalf of a Trust,  Superannuation Fund or Company, it may be wise to seek the advice of your accountant;
  • Sign the Contract for Sale and obtain a Quote from Mastai Settlements;
  • Advise the Real Estate Agent who you nominate to act on your behalf;
  • The Real Estate Agent will then forward the original contract to your Settlement Agent. If you have completed a private sale, please forward the original contract to your Settlement Agent urgently, as all contracts are required to be lodged with Office of State Revenue within 2 months of execution. (Penalties apply);
  • When we are in receipt of your contract, we will peruse the special conditions, provide advice where necessary, and post you a form to sign, which appoints us as your settlement agent;
  • If the offer is for CASH, we will also prepare all of your settlement documents for signing, including a copy of the Certificate of Title and the Transfer of Land;
  • If the offer is subject to finance, we will wait until a finance approval letter is received, and we will then post all of the settlement documents for signing;
  • Following finance approval, your bank will post out the mortgage documents and it is a good idea to return the signed documents to the bank as urgently as possible;
  • We will attend to all necessary searches and enquiries on your behalf and forward you copies of the information we receive;
  • Approximately one week prior to settlement (when the final figures are available) we will prepare a final settlement statement and advise of the amount / deposit you are required to pay.

 

Sale of a Property

 

  • Call Mastai Settlements and ask for advice, preferably before you enter into a contract for sale;
  • Sign the Contract for Sale and obtain a quote from Mastai Settlements;
  • Advise the Real Estate Agent who you nominate to act on your behalf;
  • The Real Estate Agent will then forward a copy of your Contract to your Settlement Agent;
  • When we are in receipt of your contract, we will peruse the special conditions, provide advice where necessary, and post you a form to sign, which appoints us as your settlement agent;
  • Tip: It is especially important to ensure you have ample time for settlement as some banks require 21-28 days to process a normal discharge of mortgage;
  • Following receipt of the buyer’s finance approval we will prepare and send you the main settlement documents for signing, including a bank discharge authority if applicable;
  • We will request that you are formally identified, pursuant to new regulations set by Landgate and Department of Commerce. Mastai Settlements proudly have an agreement with Australia Post, so if you are unable to attend our office, you can attend your local Australia Post to do an identity check. (There is a small charge associated with this Australia Post service) This way, we can service all seller clients in Western Australia.

 

Tips & Notes

 

  • For sale and purchase settlements we will adjust all outgoings, including Council Rates, Water Rates, Land Tax and Strata Levies
  • You will be required to advise Alinta Gas and Western Power of the change of ownership, see useful links to amend your details online;
